VIDEO LICENSE AGREEMENT
This License Agreement (“Agreement”) governs the use of video clips (“Videos”) provided by the Licensor (the original creator and copyright holder of the Videos). By purchasing, downloading, or using the Videos, the Licensee agrees to the following terms:
1 IDENTIFICATION OF LICENSED VIDEOS AND LICENSORS
This license applies exclusively to the video(s) specified in the invoice, receipt, or other transaction documentation provided at the time of purchase (“Transaction Document”). The Licensor(s) for each video shall be identified in the Transaction Document and, where applicable, in the metadata of the video file. The Licensee acknowledges that only the videos explicitly listed in the Transaction Document are covered under this Agreement and that the rights granted under this Agreement apply only to the media owned or controlled by the identified Licensor(s).
2. GRANT OF LICENSE
The Licensor grants the Licensee a non-exclusive, non-transferable, worldwide license to use the Videos, subject to the conditions of this Agreement.
3. PERMITTED USES
The Licensee may:
a. Use the Videos in any personal or commercial project, including but not limited to:
- Live performances, VJ shows, and audiovisual displays.
- Films, video productions, advertisements, broadcasts, and multimedia presentations.
- Online content, including streaming platforms, websites, and social media.
b. Modify the Videos (e.g., edit, cut, color grade, or combine with other media) for incorporation into a larger project.
c. Distribute and share the final project that incorporates the Videos as part of a larger creative work.
Clarification: The Videos must not be distributed or made available as standalone files or in any format where the Videos (original or modified) can be extracted or used separately.
4. PROHIBITED USES
The Licensee may not:
a. Sell, redistribute, sublicense, or share the Videos (original or modified) as standalone files.
- Example: You may not resell the Videos as VJ loops, stock footage, or in clip libraries.
b. Make the Videos (original or modified) available in any format where they can be extracted, copied, or reused by third parties.
c. Claim ownership or authorship of the Videos.
5. OWNERSHIP AND COPYRIGHT
The Licensor retains all rights, title, and interest, including copyright, to the Videos. The Licensee receives a limited license to use the Videos as specified in this Agreement.
6. ATTRIBUTION (Optional)
Attribution to the Licensor is not required but appreciated where feasible.
7. NO EXCLUSIVITY
This license is non-exclusive, meaning the Licensor may license the same Videos to other parties.
8. TERMINATION
This license will terminate automatically if the Licensee breaches any terms of this Agreement. Upon termination, the Licensee must cease all use of the Videos and delete all copies.
9. GENERAL TERMS
a. This Agreement constitutes the entire understanding between the parties regarding the Videos.
b. The Licensee may not transfer or assign this license to any third party.
10. PAYMENT CONDITION
a. This license is effective only upon the Licensor’s receipt of full payment for the Plugins.
b. In the event of a chargeback, refund, or payment reversal, this license is automatically revoked, and the Licensee must immediately cease all use of the Videos and delete all copies, including any modifications.
11. GOVERNING LAW AND JURISDICTION
This Agreement shall be governed by and construed in accordance with the laws of Germany. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in Berlin, Germany.
By purchasing, downloading, or using the Videos, the Licensee acknowledges they have read, understood, and agreed to the terms of this Agreement.
